1. Introduction

Welcome to Maharashtra Business (“Company”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, services, platforms, tools, and communication solutions, including but not limited to WhatsApp Official API services, RCS messaging services, customer communication tools, and related digital solutions (collectively, the “Services”).

  • “RCS” refers to Rich Communication Services enabled through telecom partners.
  • “Content” means messages, templates, media, text, or data submitted by Users.
  • “Applicable Law” means laws in force in India, including IT Act, 2000.

3. Acceptance of Terms

By registering, accessing, or using our Services, you confirm that you have read, understood, and accepted these Terms. Acceptance may be electronic, implied, or recorded through platform usage.

These Terms constitute a legally binding agreement under the Indian Contract Act, 1872.

4. Description of Services

Maharashtra Business provides business messaging, communication enablement, automation tools, customer engagement solutions, and API-based services including:

  • WhatsApp Official Business API onboarding & messaging
  • RCS messaging solutions
  • Campaign management and delivery
  • Customer notification services
  • Communication analytics & dashboards

We act as a technology facilitator and do not control message recipients or their responses.

5. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have legal authority to represent your business
  • Comply with Indian laws and platform policies
  • Have lawful consent from message recipients

Use of Services by prohibited or sanctioned entities is strictly forbidden.

6. Account Registration

Users may be required to create an account by providing accurate and complete information. You are responsible for:

  • Maintaining confidentiality of credentials
  • All activities conducted under your account
  • Updating information when necessary

Maharashtra Business reserves the right to suspend accounts providing false or misleading information.

7. User Responsibilities

Users agree to:

  • Send messages only to users who have given explicit consent
  • Avoid spam, fraud, misleading or illegal content
  • Follow Meta WhatsApp Business Messaging Policy and RCS guidelines
  • Ensure compliance with data protection laws

Prohibited activities include harassment, phishing, impersonation, or unlawful promotions.

8. Payment & Billing Terms

Certain Services are provided on a paid basis. Users agree to:

  • Pay applicable fees as per agreed pricing
  • Pay taxes as applicable under Indian law
  • Make payments on time

Non-payment may result in service suspension without notice.

9. Subscription Renewal & Termination

Subscriptions may auto-renew unless cancelled. Maharashtra Business reserves the right to:

  • Suspend or terminate Services for violations
  • Modify pricing with prior notice
  • Terminate inactive or non-compliant accounts

Upon termination, access to Services may be revoked immediately.

10. Use of WhatsApp Official API & RCS

Users acknowledge that:

  • WhatsApp and RCS platforms are governed by third-party policies
  • Message delivery is subject to platform approval
  • Template approval is mandatory
  • Meta or telecom operators may reject or limit messages

Maharashtra Business is not responsible for platform-imposed restrictions.

11. Message Delivery & Compliance Policy

Message delivery depends on:

  • Recipient availability
  • Platform uptime
  • Network conditions

We do not guarantee delivery rates, response times, or message reads.

12. Intellectual Property Rights

All intellectual property related to the Platform belongs to Maharashtra Business. Users retain ownership of their Content but grant us a limited license to process it for service delivery.

Unauthorized copying or reverse engineering is prohibited.

13. Confidentiality

Both parties agree to maintain confidentiality of proprietary and business information. Confidential information shall not be disclosed except as required by law.

14. Disclaimer of Warranties

Services are provided on an “as is” and “as available” basis. We do not warrant uninterrupted, error-free, or secure services.

15. Limitation of Liability

To the maximum extent permitted by law, Maharashtra Business shall not be liable for:

  • Indirect or consequential damages
  • Loss of data, profits, or goodwill
  • Third-party platform actions

Our total liability shall not exceed fees paid in the preceding three months.

16. Indemnification

Users agree to indemnify and hold harmless Maharashtra Business from claims arising from:

  • Violation of these Terms
  • Unlawful content or messaging
  • Breach of platform policies

17. Governing Law (India)

These Terms shall be governed by the laws of India. Courts at Aurangabad, Maharashtra shall have exclusive jurisdiction.

18. Changes to Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance.
